In Minnesota Criminal cases, the State has the burden of proof. They must convince the jury that a defendant is guilty. As a result, there are certain things that prosecutors should do and certain things they shouldn't do, unless they want defendants acquitted. As a criminal defense attorney, my job is to ask questions and establish the holes in the State's case. If the prosecutor is willing to do it for me, I will happily let her.
